A Gamer 4 Life Video Contest..

Contest Period. This promotion runs from 8/5/2009 - 10/15/2009. All videos must be received by midnight , PST, 10/15/2009 in order to be considered eligible.

Promotion. Subject to the terms herein, NETGEAR, Inc. ("NETGEAR") is providing the opportunity for gamers who upload a video to win a gaming package consisting of items selected by NETGEAR, including hardware, games, and networking products. Three (3) winners will be selected by a panel of judges from NETGEAR.
Eligibility and Restrictions. The three (3) winning videos will be selected by NETGEAR. In order to be eligible, participant must have uploaded a video during the contest period, and included their contact information so they may be reached in the event their video is selected as a winner. You may upload as many videos as you like, during the course of the contest. NETGEAR employees, officers and directors and their immediate family members are not eligible to participate in the Contest. Winners shall not be chosen from jurisdictions in which the Contest is illegal. Minors may participate in the contest to the extent not prohibited by law. If the potential winner is an eligible minor, NETGEAR reserves the right to require execution of an affidavit and/or release Affidavit/Release must be confirmed and signed by his/her parent or legal guardian. NETGEAR reserves the right to condition the receipt of the prize on the winner's execution and confirmation of a release and any appropriate tax documentation.
HOW TO ENTER: To enter the Contest, visit www.agamer4life.com (the "Website") during the Contest Period, submit a Qualifying Video (as defined below) with the required contact information ("Entry") and submit the completed Entry as directed. ALL ENTRIES MUST BE RECEIVED BY NO LATER THAN Midnight PST on October 15, 2009. Entries submitted after the close of the Contest Period will not be judged and will not be eligible for prizes. The potential winner may be required to show proof of identification. Administrator shall have sole discretion in determining whether a submitted video meets the Video Requirements. Acceptance and posting of your video submission on the Website does not necessarily mean that your video submission is eligible for and entered in the Contest.

VIDEO REQUIREMENTS: To be eligible to enter the Contest, your video must meet the following requirements. By submitting your video to participate in the Contest, you represent that your video meets these requirements (a "Qualifying Video" or "Qualifying Videos"):

It must be at least thirty (30) seconds but no longer than ninety (90) seconds in total running time;
It cannot exceed 100 MB in size.
It may only be in the following video formats: .wmv, .avi, .mpg, .mpeg.
If it contains music, you must have a license to use the music in your Video or otherwise have written authorization to use the music in Your Video;
It must be your original work and must not contain images, music, words, ideas, choreography or direction of any other person, unless you have explicit written permission to use the same for this Contest and which complies with these Official Rules in the sole discretion of NETGEAR;
It must not violate or infringe any third party's rights, including but not limited to, copyright, trademark, right of publicity, right of privacy or trade secret, and must not in any way violate any applicable laws or regulations;
It must not contain any content or performance that is sexually explicit, offensive, illegal, pornographic or obscene;
It must not contain libelous, slanderous or defamatory materials or statements, including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, gender, ethnicity, national origin, religion, sexual orientation or socio-economic group;
It must not include threats or incitement of violence to any person, entity, group or business.
It must not contain anything that may be construed as hateful or derogatory to any person, entity, group or business.
It must not contain any commercial content that promotes any product or service or contain or reference any third party names (including but not limited to URLs or hyperlinks), logos, service marks or trademarks, trade names or trade dress;
It must not have been previously submitted to any other website or entered in any competition or contest;
It must meet the requirements of these Official Rules, as determined in the sole discretion of NETGEAR.
It must not contain or depict any of the following, whether through words or imagery:

Gratuitous violence, guns or other imagery or gestures of weapons resulting in injury or death. Violence may not be used to stimulate the audience or to invite imitation, nor may it be shown or offered as an acceptable solution to problem or conflict.
License plates, phone numbers, personal addresses (whether physical or email) or any other personally-identifiable information.
Hard liquor use or product images;
Illegal drug or alcohol use or abuse;
Offensive or abusive language or imagery of any kind, as determined in the sole discretion of Administrator;
Conduct or activities in violation of these Official Rules;
Any other content, display, materials and/or images that is or may be considered inappropriate, unsuitable or offensive, as determined in the sole discretion of Administrator.

Odds of winning the A Gamer 4 Life Video Contest will be determined by the number of eligible entries received.
Prize. A Gamer 4 Life Video Contest Ultimate Gaming Package consists of a gaming console, games, and networking products. NETGEAR reserves the right to substitute the prizes with a similar prize of equal or greater value or with the equivalent cash value. The winners may not transfer or substitute the prize. All taxes associated with the receipt or use of the prize and all charges and incidental costs, if any, are the sole responsibility of the winners. NETGEAR reserves the right to condition the receipt of the prize on the winner's execution and confirmation of a release and any appropriate tax documentation.
Use of Entries. All entries become the property of NETGEAR and may be featured in future NETGEAR advertising and promotions. By entering this promotion, entrants agree that NETGEAR may use and publish their name and video in all media and types of advertising and promotion of NETGEAR products and services, and may contact each entrant directly with marketing or other information. By submitting your Video for the Contest, you grant to NETGEAR a royalty-free license (with the right to sublicense) to exhibit, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, rebroadcast, transmit, record, publicly perform, create derivative works of, or distribute any portions or excerpts thereof in any manner, an unlimited number of times, in any and all media and not limited to, the right to make any and all uses thereof, or for purposes of advertising or trade without notice and without any compensation, royalty, accounting, liability or obligations of any kind.
Notification. NETGEAR will notify each winner by the e-mail address or phone number provided to us. NETGEAR is not responsible for any delay or failure to receive notification due to inactive email accounts, technical difficulties associated therewith, or winner's failure to adequately monitor any email account. Each winner must then respond to NETGEAR within three (3) days. Should a winner fail to respond to NETGEAR, NETGEAR reserves the right to disqualify that winner and select a new winner. Individuals may request the names of the winner and a copy of these official rules by submitting a self-addressed stamped envelope to A Gamer 4 Life Video Contest, c/o NETGEAR, Inc., 350 E. Conditions of Participation. By submitting an entry for a Contest, you agree to abide by these rules and any decision NETGEAR makes regarding this promotion. NETGEAR reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in NETGEAR's reasonable suspicion, tampers with the site, the entry process, violates these rules, or acts in an unsportsmanlike or disruptive manner.
